the mother is working more hours than nessesary and the children spend more time with the babysitter and grandparents when the father has a set schedule and more stability...we're not saying that the mom is not a good mother...we just want a stable living situation for the kids

yes it is , i have a co-worker that has custody of his kids, when they live at his moms house ,i personally don't think that its right though

This is going to be tough to do as unless the mother is unfit, she gets custody of the children. Father will have to prove beyond any doubt that mother is unfit by documented proof of child or drug/mental abuse by police reports or medical records. What youre claiming or wishing for the children wont work and doesnt constitute a hostile environment or pose a endangerment to the kids. The best you could hope for would be if the judge would let the kids decide themselves who they want to live with, but only if the kids are older. But if mom is providing a loving environment, thats all the courts demand. Sorry, wish I could tell you something better. Good luck

It is very possible. But being a male sometimes makes it difficult.
I think the best would be to talk to your ex and see if she would be willing?

If not, then pull up the state statutes and find the definition of unfit. If you can prove unfit then it should be easy. Every state is different so research it. What is unfit in our eyes is not necessarily unfit in the states eyes, and vice versa.
Fees add up very very fast. Mine cost me alot.

It is less likely unless there is something wrong with her or he can prove her action is messing up her kids future and how. In Illinois there is a law firm called Jeffery Levin who fights for fathers rights. They can give you more advice.
