I am so disgusted. I moved into a house about 2 weeks living here I saw roachs in the bathroom... The landlady said oh I thought we got rid of those.. I am so grossed out disgusted and can not ever stay here.. I have had to throw away my food, my toaster, coffee pot, and I hate this place. I come in here and all I can think of is roachs.. I found them again in bathroom.. Landlord says oh spraying twice usually gets rid of them...She has cost me living here, they will not go away .. Is there anything I can do she has a deposit and I have a year lease

the landlord in california has a prima facia duty to rid the roaches from your home, to make it livable and sanitary, if the manager refuses, then file a small claims lawsuit against the landlord, siting the refusal to do anything including hiring a professional exterminator to rid the roaches, when you go to court make sure you have an estimate of the replacement costs of your items lost to roach infestation, and also include those in your damages, furthermore when you file the lawsuit sue for the maximum amount of money and specify in your lawsuit you are seeking compensatory damages for emotional distress from bieng forced to live in a roach infested inviorment, that your landlord refuses to correct, also right before you file the lawsuit, send a certified mail letter to the landlord, stating that you demand that the landlord get rid of the roach infestation, and keep a photo copy of the letter and the certified return reciept and take that to court with you as well as the estimates for items lost from roach infetation. Furthermore, within the lawsuit specify that you want the judge to break the lease, and to return your deposit, and also get a written estimate of renting a new residence, including how much deposit it will cost and the cost of a moving truck, boxes, tape, and labor of movers if needed to move into a sanitary living enviorment. Last but not least go see your regular m.d. and tell the doctor that you are stressed and emotionaly distressed from this and have the doctor write a bfief narative report of your lack of sleep, and emtional state and take the report to court with you.

I have had the same experience years ago with a landlady. Where our expereinces differ is that when I saw one on the floor and asked what it was, she told me it was a watter beetle and that was not the case at all. I had to throw everything I own away for fear of carrying them with me when I moved. I was allowed out of my lease because she told me the roaches were water beetles however, I was not reimbursed for my property. If you had prior knowledge about the roaches, you probably will not be allowed to get out of your lease.

I wouldn't worry about the lease and deposit. They are yours when you leave. She agreed to a clean, ready to move in apt. You didn't get that, so she broke the agreement.

Have you even asked her to take care of it? It sounds as if she is as bummed out as your are about it. If she refuses, you can contact that Housing Authority.
