Most likely, it isn't the dealer's fault the wrong tires are on the vehicle, it is probably the rental car company. But, used cars are sold as is, and therefore you don't have a leg to stand on unless it poses a safety hazard, for example if the tires were faulty and they caused an accident. The reason the speedometer will read differently is because of what is called roll-out. Roll-out is the distance the vehicle will travel for every complete revolution of the tires which is equal to the circumference of the tire. A speedometer is calibrated for a certain roll-out based on the tire size. Tires that are too big will cause you to be travelling faster than the speedometer reads because you will travel farther in the same amount of time. A smaller tire will be the opposite, you will travel less distance in the same amount of time. The speedometer can be recalibrated, however. The difference will be slight, so what you are driving on now should be fine.

there's a cable that goes from the tailshaft of the transmission to the back of the speedometer that spins faster as your speed increases.

The cable inside the cable housing has probably broken.

sounds like your cable may be frayed or barely hanging on, get a new speedometer cable installed
