The Legislative,mainly the Senate. While the President may appoint some one to the post,it still needs their approval.

in the US, the senate must ratify this, however the president can use a 'pocket veto', this means that ifhe submits his choice and recieves an answer within around ten days of congress going into recess, the president can hold onto his choice and it will default by law. these are seldom used but were big in the 70's and LBJ was pretty clever with them. in the UK the Prime Minister has the real final say, although constitutionally the queen (by whom all legislation and judges act) can intervene. no monarch has overturned a parliamentary decision since 1807.
