If a person pays child support via money order and actually puts "child support payments" on the money order but isn't through the court system, is it still considered a gift by law and if not will they have the same rights for visitation of the child by law. The payee currently lives in Virginia and the custodial parent lives in Georgia

No it's not a gift, the money is clearly earmarked for a certain purpose only. I don't know about child visitation, but I would get a laywer and make sure of my rights.

no, it is considered child support. The only reason the court gets involved is if the payee sues you for more than what they are receiving - then it is court ordered. The non-custodial parent has every right to visit their child, unless there has been a serious problem where a restraining order exist. The only thing about money orders is you have to go through a lot of stuff to get copies of them if you are ever challenged in court, unless the money orders are from a bank. Make sure all receipts are kept.

I paid child support for several years till receiving custody of my son . I was told directly in writing that any payments made that didn't go through the child support enforcement agencies office would be considered a gift . Child support and visitation are 2 separate issues and are handled separately.

never had any child support for my daughter, get a job and support your own kids....

my daughter and i dont need a man in our lives to pay our way, we can pay our own way, if we cant afford it we do something else that we can afford.
