my husbands ex wife wants more alimony, i want to sue her for something, we have a small child together and she is all alone, noone else to take care of but herself. he pays her 1000.00 already she wants 2000.00 A MONTH! she must think we are rich? i fell i should be able to sue her for trying to hurt our family, and if she gets this, we will loose our house. and yes we have an attorney, i just want other opinions too.

I am not at all thinking of myself in this matter, my daughter means the world to me, we strive everyday to make sure she has a roof over her head and she has the best of everything in her life. God, love, health! and her mommy and daddy!

you cant sue her unless she is doing mental,emotional,or physical harm above and beyond asking through court alimony..i know firsthand what a bit** this process is ,but go through the lawyer ..be kind to her face..and if she calls constantly or sends letters that aren't appropriate then turn them over to your attorney ..when your husband goes to court you must make sure your husband brings documentation that he is supporting his new wife and child,make sure he brings documentations of monthly expenses any Dr bills ,daycare bills ,make sure he shows without a doubt he cant pay extra..i know you want to sue her i have felt the same way but tell yourself you are better then she is ...and thank god he doesn't have children with her..also make sure that the lawyer bring it to the judge that shes not able to sue again for alimony and this alimony payment should get a time limit on it so she can support herself at some point..the judge legally cannot order him to pay her an amount that will cause you and your child to lose your home..she will go away EVENTUALLY..she just wants to try to make you think she still has control ..don't sink to her level..good luck

Where you have only been married a year and a half, I wouldn't worry about it. Check into your state's laws on Alimony because I know in my home state you only can get it if you've been married something like 7 years. When I got divorced, I too was making a significant amount more than my ex - but since we hadn't been married for 7+ years, he couldn't get a cent from me. If you are making that much more than your husband and you did divorce, the only thing that it would affect would be the support amount. And if he's as lazy as you say, it sounds like you would get primary custody anyway. Good luck with this - I hope it doesn't come to that point for you.

You can sue for anything, winning is a different matter. You will first have to show "damages." The damages will have to be quantifiable in a dollar amount. This will be exceptionally difficult to do in what you are describing. First, what has she done that has cost him/you money? How? Was it intentional? Nasty business all this. Try to get her to remarry - that terminates most alimony clauses.

Well the court order is for 1000. and that is what her greedy azz will get because she needs to know that alimony IS NOT child support so she needs to move around and do something productive like GET A JOB and stop trying to cause problems for you and your Husband I have to assume shes the one who didnt want the divorce since shes the one being vindictive.

You could but you'd be wasting your time and money.
She has every right to seek more alimony. If she deserves it, she'll get it. If she doesn't, she won't.
Alimony will be based on your husbands income. If it hasn't changed since it was last settled, I doubt she'll get twice what she's currently getting.

I don't think you can sue her. Although it would be nice. I think she is probably mad that he is married and happy with you and a child together. Hopefully the judge will see through her and deny her clam. Good luck and hang tough.
