No, that would be illegal. He has to pay for the time you work.

The labor laws probably require that you be given a half hour break if you work over 8 hours.

Call a labor attorney and verify if that is the case. Know what you are talking about. If she is obligated to give you that break by law, she's trying to cover herself by having records that prove you got it, even if you didn't.

Then the question becomes one of what you want to do about it. Anything beyond talking to her about the situation puts your job at risk, and even talking to her might do that.

There's a lot of possibilities here. A half hour of free labor per day, how many employees are there, and how long has it gone on..... but on the other hand, this practice might have been factored into your hourly rate, so it could be illegal but fair.

Find out whether or not there's a labor law that mandates the break. That's your first step, find out why she's doing this.

He is required to give you a break every 4 hours and pay you time and 1/2 after 40 hrs a week or 8 hours a day depending on arrangements!

yes take a break there nothing he can do b/c why should you give him that extra time, he doesn't pay you when your not there?

no it isn't. But if you have a break take it. Why work for free. Take your break.
