To register a trademark, that's done either through your Secretary of State for a State trademark or the US Patent & Trademark Office for a Federal trademark.

If you are only conducting business in one state, then a State trademark is most appropriate. If you conduct (OR are planning to conduct) business in at least 2 states OR between the US & any other country, you can file for a Federal trademark.

Prior to investing your time, money & effort into a name, it is strongly advised that comprehensive research be conducted to ensure that the name you're interested in is truly available.

This entails searching the pending & registered Federal and State trademark files as well as the US National Common-Law files. Then, if clear, you can decide if you would like to file for a Federal or a State trademark.

The State trademark fees vary, anywhere from $15 to $125. The USPTO charges a registration fee of $325 per International Class.

First, you get a trademark through use of your word, name, symbol, or device, or any combination thereof, to identify and distinguish your goods or services from those manufactured or sold by others and to indicate the source of the goods or services. Thus, your cost of "getting" a trademark are those costs you incur in developing and using your trademark as a trademark to distinguish your goods and services over your competitors.

You don't have to register your trademark, but it is advantageous to do so. Below, you'll find the link to the Patent and Trademark Office's processing fees for applying to register your trademark. Of course you could apply to register a mark yourself, but you may want to consult an attorney that is knowledgeable about trademarks. You'll also want to conduct a search to determine if someone is not already using your exact mark, or something confusingly similar.

All told, if you conduct a search and engage the services of an attorney, minimal cost (including PTO fees) is $1,000. Fees will vary by attorney and search service.
