I took a new job last week and start my induction on tuesday. I really want this job as the prospects are great and the hours are flexible so will fit in with my young daughter. However, i think i may be pregnant again. Do my new employers still have to honor my contract when i tell them or are they legally allowed to dismiss me after my probation?

the job i have is at mothercare so im hoping they will be ok since it is a shop aimed at pregnacy and baby!

You do not say what type of job this is..
Usually Probationary periods allow for a test drive and at teh end of such the employer can let the employee go without reason,, or without even having a reason to do so.

I tell you... thing is... you are not obligated to tell you employer anything about your medical health and they are not allowed to ask except in the case of a employee contract or employee physical. The HIPAA laws are strtictly enforced. Its really none of thier business if you are pregnant.

Now where this could be an issue... would beif your job is something like swim wear model ot other job wjhere your appearance is key in a non pregnant form....

Anything other than .. frankly I would not tell them or anyone else at work until you beging to show or somebody asks.

You are not legally obligated to say a thing and they legally cant even ask you.

If this job is important Id not say anything til after the probationary period.

Most employers would jump at t6he chance to dodge the whole Pregnant going to take leave employee thing in a new employee if they could..

As far as i have researched before, you do not have to tell the employer untill you are about 25 weeks (15 weeks before your baby is due). Obviously you may be showing before then.
But they cannot dismiss you for being pregnant. If you are dismissed, you could take it further and they will have to give you an acceptable reason in writing.
However you will not be allegible for Statuatory Maternity pay, but you may be for Maternity Allowance, and obvioulsy you will still get your 26 weeks leave. Oh and congratulations.

If I were you I would give it a few weeks before you say anything. You don't know for definite that you are pregnant yet. If you are be aware that although you are entitled to full maternity leave you will not be entitled to maternity pay as you haven't worked there long enough by the time you are 25 weeks pregnant.
The law is changing in April and you will be entitled to 9 months leave instead of 6.

Your employer is not permitted to dismiss you from work at your probationary period just because you are pregnant. The probationary period is a period when your performance is under review.

Government law also states that:

You have the right not to be discriminated against for reasons of your sex including being pregnant, your race or any disability, or for being a member of a trade union, and you even have the right to time off for maternity leave even if you were pregnant when you started the job. (However this does not include SMP)

As far as I am aware, they may be able to fire you if you were not honest with them in the interview but if you didn't know about the pregnancy then they have to keep you on. Best to check with ACAS or some kind of employment law people first though.

They are still legally required to honor your contract. I am assuming you are in the US. It may be different in other countries, depending on where you live.

it would be against the law. they cannot fire you because you're pregnant. they may invoke different reasons though. if you're not asked, do not say anything, keep going, and do your best in the job, so not to give any reasons to be fired... apart from being pregnant.. _:)

Congrats, but employers see preganant women as burdens, and expect to be displaced. Sorry to say, but it's true. Goodbye career.

Don't tell them straight away !!!! Wait a while and then tell them...pretend you didn't know !!! You've got nothing to lose really...............but i reckon the longer your there the better chance of staying there xxx Good Luck xx
