Why did you wait? To save money? To just date around? To get use to the idea of being divorced? Why did you wait to file once you knew the marriage wouldn't work?

So my ex- would have health insurance and I could make sure the auto insurance was paid, until she was on her feet.

I've had friends that did this, and it was motivated purely by finances, including issues of health insurance for the couple and their children and the cost factors.

And, some of them like to leave the "door" open, just in case things change...

Also, one partner might be thought to be coming into some money, and if the marriage is still 'on the books', a good lawyer might be able to call it community property.

My husband and I split up after 10 years of marriage, We were not legally divorced for another 2 years. It wasn't a pressing issue for either of us.

You nedd to file now, cause I'm divorced and from the date we filed we had to be seperated for 90 days then we can file then it took three to four months.
