I have already written to the Office of the Clerk of the US Supreme Court. Perhaps others may wish to do the same. In this letter, I have notified the Court that the Constitution has come under attack. Since only enemies launch attacks, I have declared the President and the majority in Congress, who sent the Military Commissions Act to the President for his signature, to be "enemies of the Constitution". Since all public officials are sworn to "defend the Constitution of the United States against all enemies, foreign and domestic," it is my hope that the Court will take action.
Here is an exerpt from the letter:
"Enemies of the Constitution include those who violate its provisions, those who seek to diminish its scope and reach, in the absence of an Amendment ratified by three-fourths of the States that constitute our Union.
"I understand that the Supreme Court of the United States has ruled that the terms of our Constitution are applicable not only to Citizens of the United States, but also to aliens on American soil.
"The Constitution states that “the Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”
"The Military Commissions Act, which the President of the United States recently signed into law, purports to strip from certain aliens the Privilege of the Writ of Habeas Corpus in the absence of either Rebellion or Invasion. The terms of the Military Commissions Act are, therefore, in contravention of the plain language of the Constitution of the United States. The Military Commissions Act violates the provisions of the Constitution of the United States, and seeks to diminish the scope and reach of that Constitution, in the absence of a duly-ratified Amendment. Therefore, the Military Commissions Act is an attack upon the Constitution of the United States.
"Only enemies launch attacks. By signing the Military Commissions Act, the President of the United States has shown himself to be an Enemy of the Constitution of the United States. By sending that Act to the President for his signature, a majority of both Houses of the Congress of the United States have shown themselves to be Enemies of the Constitution of the United States.
"Please accept this letter as notification that the Constitution of the United States has come under attack by its Enemies, and that these Enemies are in control of two Branches of the Government of the United States."

In family law, a parent who has been denied custody of his child by a trial court may file a habeas corpus petition. Also, a party may file a habeas corpus petition if a judge declares her in contempt of court and jails or threatens to jail her.
even Lincoln suspended habeas corpus
As the Civil War started, in the very beginning of Lincoln's presidential term, a group of "Peace Democrats" proposed a peaceful resolution to the developing Civil War by offering a truce with the South, and forming a constitutional convention to amend the U.S. Constitution to protect States' rights. The proposal was ignored by the Unionists of the North and not taken seriously by the South. However, the Peace Democrats, also called copperheads by their enemies, publicly criticized Lincoln's belief that violating the U.S. Constitution was required to save it as a whole. With Congress not in session until July, Lincoln assumed all powers not delegated in the Constitution, including the power to suspend habeas corpus. In 1861, Lincoln had already suspended civil law in territories where resistance to the North's military power would be dangerous. In 1862, when copperhead democrats began criticizing Lincoln's violation of the Constitution, Lincoln suspended habeas corpus throughout the nation and had many copperhead democrats arrested under military authority because he felt that the State Courts in the north west would not convict war protesters such as the copperheads. He proclaimed that all persons who discouraged enlistments or engaged in disloyal practices would come under Martial Law.

Here is what the law says (from the Newark Star Ledger 10/17/06): The new law says: "No court, justice or judge shall have jurisdiction to hear or consider an application for a writ of habeas corpus filed by or on behalf of an alien detained by the United States who has been determined ... to have been properly detained as an enemy combatant or is awaiting such determination."
You have to be an alien and you have to be an enemy combatant. Not a dissident, a combatant.

This is a good question, I would say if you are a protester against tyranny or against bad policy passed by congress such as the Habeas Corpus issue then you may be in big trouble in the very near future. If you are one who goes along to get along then maybe you have nothing to worry about until you are told what to do on a daily basis like a slave! Do I feel safe, Hell no, and neither should the very people in office that voted for this bill to be passed. Wake up America!!!

When did they suspend habeas corpus for U.S. citizens? I know they signed the MCA of 2006 suspending the writ of habeas corpus for non-citizens, but I never thought they would actually do it for national citizens. When did it happen? Do you have a link? Where did you see, hear, or read the actual words from a document suspending an American's right to habeas corpus? That would really suck. Please show me proof, please.

Habeus Corpus has not been infringed on for citizens. I've read the bill that was signed and it was very clear on that point.

Of course we should feel less safe. Its just one more thing over our heads. Another constitutional right gone. People can say it only effects terrorists but its who has the right to label you a terrorist or combatant that worries me. The future is not going to be good on that one.
