This corportation has no contract with nobody, they exist, but they have no lease or anything! I am buying someone elses lease, but I want to put my business in it. The current lease holder allowed the people to put their corportation in this building, but doesnt care if I take over and kick them out since there is no contract! In the state of Louisiana, can I legally evict them??

In louisiana when you buy a property it is subject to whatever leases that exist. If there is no actual contract then the lease term is considered to be on a month to month basis. At which point all you need to do is provide 30 days written notice to vacate. If they don't then you would have to file for an eviction. If there is a lease then the lease dictates those terms. If there is no specific provisions then they would have a right to remain for the full term of the lease at which time you wouldn't renew it.

It sounds like they are month to month so I would begin with a certified letter to the address advising them that you are not renewing the month to month and please vacate by whatever date you set.

If you buy a lease, you would get the property. After you paid the menoy for that lease, you should go to the Local Lease Administer to transact the ownership process of the lease. When you get the final property of the lease, you are the only one legal owner. And you have the right to evict them.

You have to ahve an attorney review the lease you just bought to see if you have thr right to ask them to leave and if so how much notice you would ahve to give. You should have ahd an attorney review the lease prior to purchasing it from the previous owner.

Logically, yes, but things may not be all that simple. The influence of the corporation would make a difference, remember they may have deeper pockets than you when it comes to litigation. Do consult a lawyer rather than trying to find quick fixes on the net.

If they do not have a lease you shouldn't have a problem. You may want to seak legal council to be sure.
