Rule 7 of Service Tax Rules, 1994 (as amended vide Service Tax (Third Amendment) Rules, 2006) requires every service tax assessee to submit the half-yearly return by the 25th of the month following the particular half-year. There is no extension in date of filing Service Tax return and return or the half year ending 30th Sept is to be filed on or before 25th October, 2006.
However, in case the last day (25th) is closed office day due to holiday / week end, you can file your return on next working day (Section 10 of the General Clauses Act, 1897 refers). Please note that if 25th is closed office day and you fail to file return on next working day, you will invite penal actions under Section 77 of the Finance Act, 1994.
