My landlord is planning on terminating my lease because my neighbor told her my boyfriend was staying with me! Which is not true. He watche s our kids from 3pm-11pm and I take him home at night. He only stays on the weekend. My landlord also stated that she didn't want him on the property no more because he looks scary. He is white and has gold in his mouth. Which I feel is a racist comment. She has said that he no longer can come to my house to watch his kids, where I pay rent at because he looks scary to her and if he does she is going to evict me. Do I have a case if she evicts me on these terms???

I am black and he is white. We stay in a mostly black neighborhood. Also my friend has been staying with me for the last 2 weeks and she is in and out like a fly and she brings all kinda guys over and I haven't been called to the office 1 time about her staying there. Sounds a little funny!!!

unless he live with you and the lease state only you and no one elss then you yes the landlord can evict you.on the other hand land lord can`t tell you who can or who can`t vist you
you need witness or you can video tap your landlord any time he or she make that remarks toward this person but the best thing to do is you give a 30 day notice and find a new place to live it a matter of time before your land lord kick you out ps your case is different because you have a lease

She has no right to determine who visits your house unless it is stipulated in the lease. When you rent the landlord can only visit your apartment if he suspects that you are causing damage to the property and then only when she makes an appointment.
if you pay the rent on time and don't disturb the neighbors
there is no reason to evict you.

Nope. Your landord can evict you for having someone staying, even on the weekends, that isn't on your lease. The only way to truly be able to dictate who comes over and when is to have your own property.

You have to prove it was due to discrimination. I highly doubt she will write on your eviction papers it is because you have a white boyfriend with gold teeth who scares her. If that is what's on your eviction papers, then yes... I'm thinking you have a case. If it is another reason she gives you, then your case may be harder to prove because it is your word against hers. My guess is that you haven't been the best tenant and this is fueling the eviction.

I afraid you don't to honest which I could I help now if it was cause you were black maybe but a very fine line but she would probably win. I would just look for a new place a move on it not worth the fight I sorry unfit people are not always nice.

Just because she is your landlord doesn't mean she can control your life and tell you who may or may not visit you. She might have rights has who lives there but so long as he maintains his own domicile, he does not live with you. That is my layman's opinion based on experience but you would be better off consulting a legal professional.

you might have a shot,when he hands you notice of eviction find out on what grounds and take it from there,if your in California..Hes screwed

I find it hard to believe that you take him home at night,
especially of they are his kids.
But I would have to know more , for example where and with who does he live and is he working
