First of all, how and why did you lose them? If the court took them away because you werent a good parent, you will have to prove yourself fit to have them back.

The court is usually fairly good at finding which parent is the best for the children. You couple that with the rare occurrence that a father gets custody, and you have a good case that they are where they should be. I know that it is difficult to be separated from your children but you need to think what is best for them. Yes, even if it is not what they want personally. At 16 children tend to use parents against parents. However, lets say you both are decent parents. Your first attempt for communication with your "X" should not be through the court system, on this subject. Otherwise he will immediately be on the defensive and you will get nowhere but poor quickly.

well if someone else has them then you need to go to court and address the court and give reasons why you want them back and if they were not abused then the courts will rule in your favor because they are old enough to say where they want to be and the judge will also take that into consideration.

if they are 16 and you live in UK then they can decide for themselves...it's up to them to choose...i dont know the law in USA but just tell who ever it is who has them that they want to be with you....
