My husband & I went for a divorce & we got denied. There is no children or property between us. Married for 16yrs, seperated for 2 yrs. Being we both agreed to the divorce we didnt have lawyers. We filed all the paper work needed & went in front of the judge, he denied it. He had us go on the stand to present our case, not really knowing what we was to say or due!? We both know of people that have filed for divorce like us & never had to take the stand & theirs was granted. Dont know what to do at this point & time, any advice?

If you didn't do it with any lawyers then you probably used a kit and not all kits are good in all locations. Then too, he may have felt that the information you provided gave an unfair advantage in his experienced opinion. So, he is waiting for the lawyers to present the same again, and knowing what they know the lawyers will have spotted and addressed the judge's unspoken concern.

Other times that I have hear of a divorce being denied is that one party really didn't want the divorce (which tends to work only with women) or there were grounds for a divorce (which may be your case) when things have not been sufficiently proven. Two people getting along well but wanting to part are going to have to give some persuasive argument of why they simply can't live together--if irreconcilable differences was your grounds for divorce. Some states have no fault divorces, so check on that avenue, one of you may need to move long enough to establish residence and then divorce the other. Of course, after some suitable period (probably not immediately, some places might construe your "residence" as fraudulent), then go where ever you planned on living apart at.

Was your marriage legal? Did you marry him just so he could stay in the country? Something is fishy about your story they only deny divorce if one of the parties disagrees, I think you married for citizenship and the time limit is up he is a citizen and now you want to divorce/ The judge is on to you i know i am right . BE MORE CAREFUL!

The only thing you can do at this point is get a lawyer. They will be better able to argue your case for you. They will also be better equipped to file all the necessary paperwork to get an appeal of the judge's decision. Good luck!!

Never heard of such a thing. Refile. If two people are in agreement to dissolve their relationship, and have no estate to declare and no kids, and didn't use an attorney, your desire for a divorce cannot be denied, is my understanding. When we did it, we used internet papers, filled them out, submitted them to the courts in our county, it got stamped, each of us signed, and each of us was sent copies as to when the divorce would be final. that was it...... Advice? Refile.

No, however why dont you employ that for your potential and get an anullment rather of a divorce. That is what I could do. Consult your lawyer, it is going to grounds so that you can get an anullment

I suggest finding a lawyer. Somehow you did not make your issues clear enough. It will be worth the expense to have things done correctly.

I think you two need to consult a lawyer.
In some states, you need a reason like adultery to get a divorce.

Get any lawyer and do again. You don't have to deal with court and they know how to make this right.

yes i have sometimes judges hold up on divorces cause they think you may reconcile and get back together,
it does happen good luck
