Finding applicants who say the right words and become a problem when they are hired is a problem I am running into. I want to call previous employers and find out what thier track history is. Legally I dont want to say the wrong word and have a lawsuit filed against me. Trying to protect myself

All you can ask is if they would rehire this person. It's illegal to give a reference that would prohibit an applicant from gaining employment elsewhere. Previous employers should be contacted BEFORE the hiring is done, but all they can do is verify length of time at the company and salary. That's about it, and that's also why so many companies have a 30 to 60 day probationary period in case the employee doesn't work out.
