It could be something as simple as swim bladder disorder that is causing him to float like that. Try fasting him for a couple days and give him a thawed deshelled frozen pea.
The black spots could be ammonia burns. When the fish is in very high ammonia it causes the fish to burn, once it starts to turn black it means that it is healing. When the ammonia goes down when a tank is cycling the nitrite will go up. Both can kill any fish, some easier then others. Check your water and make sure you have no ammonia or nitrite, if you have nitrate then your tank is cycled.
If the new container doesn't have a filter and you are not changing the water everyday he will most likely die from ammonia poisoning.

if you are attached to the fish, you can take him/her into the local pet shop or where you got the fish from. They can usually tell by looking- what the fish has, needs, or it can even be helped. I had a fish that I had sentimental attachment too, but there was no help for it. They suggested clove oil to " put it to sleep", since it was gonna die anyway. The oil kinda anesthetize the fish. I thought that was a kind thing to suggest.

My fish did that same thing so it's gonna die. It died a day after to just wait and flush it whens it's dead so it wont have to die in a sewer...Maybe you can get a new fish? Or a new pet?

Not much you can do. Dump some warm water in the tank, and stir in a GENTLE circular motion to get him swimming.

a humane way to dispose of the fish is to freeze him. He'll just go to sleep and then die.
