two months ago i lost my job and i couldnt pay the rent in a house ive lived in for 9 yrs, but my very nice landlord agreed to let me stay til i found a job. but it took awhile and he needed money so a month ago he moved a guy he knew in my house to be my roommate and share bills. i initially agreed, but the roommate is a low life and has a dozen low life friends, some obviously on crack, some homeless, who are always in my house now. and he is unsafe, i can wake up at 5 am and the front door is wide open and hes gone to bed. this is scary. we live on a major street and there are stray people walking by at all hours of the day and night. i have a new job and i could stay here and pay my landlord what i owe him, but i feel he has negated my obligation to do that with the lifestyle i am forced to live now, and besides, its been so unbearable there i havent really 'lived' at home in a few weeks. ive been staying with family. what do you think? what should i/can i do?

by way of further explanation, there is not and never has been a lease. just a verbal agreement with landlord.

you are on a sticky wicket, first you have not fullfilled your end of the contract,by not paying the rent ,your landlord has the legal right to evict you. but with your landlords goddwill you still have a place to stay. now that may seem hard, but look at the situation you put your landlord in. he has to fund your unemployment, he probaly wishes he never took up this other persons offer given what you have described, my advice would be to write a letter to your landlord stating your concerns over the use of the property, and the security of his property, this may be a better way than having a confrontation with him over your rights. Sounds like you got yourself in to quite a fine mess Ollie!!!

If you could stay with family now why the heck didn't you move out back then?

First of all, unless you signed a new lease with this "low life" renter on it then your going to be the one who has to go to small claims court and file a "forcible detainer" action against this guy to get him out of the place yourself. Is he supposed to be paying YOU rent? If not then just give your landlord a 5, 10, 30 whichever it is Days Notice of Intent to Vacate/Request for Return of Deposits notice.

He had no right allowing someone else move in with you and you were stupid to let that happen as your lease was with the owner and did not include a "boarding" option to allow strangers to come in whenever the landlord felt he needed someone else in there.

Could you call the police for "disturbing the peace" ordinances which I 'm sure the renter is probably breaking!

Get yourself a video taping surveillance camera out there buddy cuz your gonna need it!

Check your local Landlord/Tenant laws and get to work before everything is sold or stolen!!

Everything in business is negotiable. Pay what you owe for back rent, etc and be on square terms with your landlord, then let him know that you intend to move out unless the low lifes are out. Being that you are a responsible tenant, he should be willing to work with you to a mutual agreement.

I would make arrangements to pay him back rent and move out.

If you still want to live there then tell him you no longer need a roommate and ask him to change the locks at your expense.

You are the tenant and lessee. Therefore primary control of the aprtment is yours. You can even evict the person but you need to check your local law.

WELL THE BEST THING TO DO IS GET GIVE YOUR LAND LORD A 30 DAY NOTICE SO YOU CAN MOVE OUT MAKE SURE YOU AND HE DO A MOVE OUT INSPECTION AF THE HOUSE ..SO THAT THERE WONT BE A BIG COURT ISSUE AND ALSO MAKE SURE YOU HAVE PAID WHAT YOU OWE HIM BEFORE YOU GIVE NOTICE OF MOVING OUT IF THERE IS A SECURITY DEPOSIT INVOLVED .............. IF IT IS ONLY YOU WHY WASTE MONEY RENTING A HOUSE WHEN YOU COOULD BE BUYING INSTEAD OF PAYING OFF THE LANDLORDS...GOOD LUCK

call the law on those crack smoking fools then you can get your place back pay the land lord what you owe while they sit in jail and tell him they are not welcome there any longer or you will have to move there are a few sites that deal with landlord tenet issues look one up
