This depends on the state. Some state law require all parties to a conversation to know it is being recorded. Other states require only one party to know and consent to the recording. If you do not intend to tell what is said then no one will know anyway and it won't be an issue.

If you want to use it as evidence they have to know they were recorded (in canada at least ) the evidence act. But a judge can allow recording a person without consent, but you need the judges opinion first.

Example: someone leaves a message on a machine, that can be used for they knew they were being recorded. A wire tap is permission from a judge without the persons consent.

If you record something without someones knowledge, it may be used to prove perjury.

Example: a person says something under oath that was different than something you recorded, you can introduce it as evidence but only to challange the character, not to use what was said as evidence to truth, but to show there was two different statements from the same person.

Or can be used as a case for a prosecutor to charge one with purgery.

Using a recording is a fine line follow permission rules to be safe.

And yes you can record anybody you just can't use it.

In public I can record anybody, for the rule is to privacy expectations of being in public, but a private as in invitation to your home or phone call is a reasonable expectation to privacy.

It is illegal to record another's voice without permission in Ontario, Canda, regardless of what you do or intend to do with the recording. You can freely record video. Oh, and by the way, yes, she is cheating.
