depends on the situation, people need to check the laws in their state before jumping to conclusions or answering on here..in most cases there is a 3 yr difference. Which means a girl who is 16 and a boy is 18, is not statutory rape, even though a 14 or 15 knows what they are doing there has to be an age cut off somewhere, what about a 12 yr old and 17?

Hi there,
When a man have sex with at women below the age of 16 but above 14 years with her consent, he will be charged under cap 353(women's charter) sec 140(1)(i).
If the girl is below 12 years, he will be charged under cap 224(penal code) sec 376 irregardless of the consent. This also applies if the man rapes her as explained under sec 376

There are some states that obviously want to criminalize those who are just a few years older than those just below the age of consent. Frankly, I'm kind of sick of the "the sex was consensual" defense. Sex between those who are not prepared for the consequences is never okay.

no i donnt think they should.in cases like that if both are consenting, then i do not believe the man should pay the price. how can they say it is rape when both are consenting. well some may say, she is to young, she did not know what she was doing. but if that same girl, went out and murdered someone she would be tried as adult and she would know what she is doing.
