okay my brother and his ex girlfriend have a 3 year old together and my brother has been paying child support from the time he was born but my brother went into the navy when he was 6 months old and just like 43 days ago my nephews mom left the state with him to move to virgina and she hasnt called she has told the judge we dont have a number or address.and my brother and i want to see my nephew and we cant find her.i thought by law she had to give us a address within 30 days of moving.my brothers child support is directly taken from his account threw the child support angency so he never sees where the money goes so what are his rights and does anyone know what sites i can go to to find info out about this?

Your brother can get court orders to bring her back and live within a reasonable distance so that the child can be contacted by him.

Fathers have alot of rights these days, and they are to be very much included in their children's lives, alot of consideration is given to this through the eyes of the court.

Its is a good thing that he is paying child support, because that will be looked upon in his favour......

He needs to get a lawyer ASAP, he can authorise for the lawyer to contact the child support agency on his behalf, to try and find the mum.

A lawyer is your only hope at finding her. If he wanted to be a little nasty he could with hold the child support money, and she may contact him!!........lol....( but obviously keep the money seperate so it can be given to her at a later stage)

You need to file a motion with the court in the state where the girlfriend was living and attempt to get it served at her last known address. This is going to be difficult as you will not know where to serve her with the papers. If she told the judge where she lived, (which probably means she filed something with the court) then the court will know her address. Also, the child support agency will likely have her address. You need to find out where she lives so you can get her served with a motion to alter visitation. Good luck, this is a tricky one.

I know in Kansas it is standard order to give notice before even moving out of state. And if I am right they are suppose to give notice through the court.

He will probably have to get an attorney.

its your brother's right that he knows where the child is located. teh ex wife cannot move out of state wihout notifying your brother.

you should call family court services, the police or even cps. this wont be considered kidnapping if she has physical custody of the child.

um, i believe that uless thats okay with him that she leaves, she has to go to court and have a judge rule it.
