It is neither Neddie, it is a control move by the repuglican president and the repuglican party, it has so much room for abuse that everyone, repuglicans and democrats should be up in arms about it. Hopefully the supreme court will do the right thing, but in the mean time be very wary of a president that has eroded the constitution in such a dramatic fashion.

This does not just apply to terrorists, because now the government can lock up anybody they want with out charging them or giving the prisoner his day in court. The sad thing is that it is the rit of Habeas corpus that seperated us for the Saddams, Stalins, Adolphs, Amins, Maos and other tirants of history. Do I trust George Bush to make that decision. Get real. We pointed to the russians through out the cold war for locking up people with no due process and now because you are shaking in your boots you want to run to that system... It's just insane. You need to look hard at the things that make America the best place on earth to live and idiots like george and the right wing congress are dismantling it in front of your eyes. To respond to the answers above, any non-US citizen who is *suspected* of terrorism has lost the writ. How do we know that this determination is made properly, if it is made exclusively by the executive branch? It could easily be applied to, say, someone who is considered a troublemaker politically.
It's homeland security run amok, presented as something necessary using fear tactics.

It's a Democratic fear tactic. The law specifically states that it only applies to aliens. Aliens are specifically defined as anyone other then American Citizens within the law itself. Ignore Olberman and actually read the law. It's not that long.
