He does have the right to a DNA test, all he has to do is go to a lawyer explain the situation and then get a court order stating he wants a DNA test done of him and the baby. He will get his mouth swabbed and so will the baby, they also do blood test too if not the swab. The woman can refuse all she wants but after the court order the right is in-front of her and the DNA test can be done.

I think the baby has a right also to grow up knowing who his real father is instead of the mother playing god it takes 2 to make a baby and there are fathers out there willing to do right by there child and if the father is wanting a DNA then he obviously want to care, love & support the baby why would the mother refuse if she has nothing to hide

I think just because he jizzed in you doesn't mean he deserves to be a father. There are other people out there who would love to play the role of REAL father, regardless of genetics or not. I think it doesn't matter about the man unless he SERIOUSLY wants a part of the child's life and wants to do anything to BE A FATHER. ie Get a job, pick up from school, be able to take child certain days a week when needed, never be too busy for the child. Does that sound too tough? Hmm, does it?? Then they don't DESERVE to be a father and should go somewhere to grow up before they decide to make that same mistake again.

at the beginning, why is she mad that the different guy needs a DNA attempt? If she is scandalous adequate to sleep with 2 men so close jointly, then why don't you a 0.33, fourth, or 5th? the guy has each top to prefer it and it sounds to me the reason SHE would not prefer that's as a results of the fact she is likewise afraid it does no longer be his. i think of she has no case, any decide is going to look on the certainty that there are diverse opportunities of fathers and that the DNA attempt desires to be taken.

All states have different laws to these type of situations, contact a lawyer dedicated to family/ juvenile law. They may be able to get a court order stating that mother and child must present themselves for DNA testing on a specific date. Is she on any type of assistance? If she is he could call the agency and give his name as a possible candidate and they may tell her to get it done or she could lose some of the services.

I completely agree with bumblebee. Don't listen to the other guys. Not wanting the test doesn't mean the she is automaticly guilty. But if she is getting government assistants (cash aid aka TNAF) then she might have to if not then she doesn't need to she doesn't even have to give the baby his last name. My baby has mines. He just might be hoping it isn't his so won't have to provide, you never know because why would he ask if he really loved and trusted her. No pregnant women needs to be treated that way, especially towards the end. Just be there for her.

He needs to take her to court. If they were not married most courts will require a DNA test before ordering a judgment for child support. If he is found to be the father he will have rights to visitation.

She is going to have to prove it. The courts will order the test done. I'm thinking her lack of cooperation is enough to convince me that even she has her doubts that this guy is the father. If she was so sure she'd be willing to take the test.
