Depends on which state you live in. You need a lawyer to ask a court for an easement through the private property.

Don't understand the question? but are you saying that your friend "bought" some land and he is having a hard time to get there? and the only way your friend could get there is threw a private road and by the way, is private land? Well, I think the real estate agent should of disclose this information with you and you should contact the agent to explain the situation. Also, contact the city of land development department to explain the problem.

Find out who owns the road. He'll need to ask that person for written permission to use the road for the duration in which he owns the land. He'll need to abide by any conditions of the agreement. Any violation will be illegal. If no agreement can be reached, then he can't legally use the road. The person who owns the road is not obligated to allow anyone access to it. This is one of the differences between a private road and a public one.

Your friend needs to contact the realtor who he bought the land from and the county clerk to find out if access to his property is by that gas road it could have been grandfathered in to the land use.
