Long story short, my pharmacy gave me the wrong prescription and gave me a heavy dosage of controlled narcotics instead. I am only 5'4, 105 pounds and I took just one and went into cardiac arrest. Now I am out of the hospital and am furious. I am not sue-happy and don't like people who are, but the pharmacy has been very difficult to deal with and unremorseful. I practically died; as it is, my heart muscle is permanently damaged. What would you do in this situation? Would you file a lawsuit?

My physician wrote the write prescription, the pharmacy just filled someone else's and put my name and info on it. They have grudgingly admitted they were in the wrong. So it has nothing to do with the doctor.

If you suffered any permanent impairment, you need to make certain that your future is secured as much as possible. I'm not 'sue-happy' either, and realize accidents happen, but this isn't a questionable case.

Do not go to one of those 'personal injury' law firms you see advertising on television or on billboards. They'll just look to settle out of court for whatever is offered and claim their split. Look for a top-drawer larger law firm that also does personal injury and medical malpractice. If someone tries to tell you they can promise you an outcome or a certain settlement for using them as opposed to going it alone or with someone else, run. A good attorney will evaluate your case and tell you its merits and weaknesses, and perhaps go over some case law of other suits as comparison, but will never promise an outcome.

I would DEFINITELY sue!
But, be sure that you can prove that they gave you the wrong prescription. Will your doctor back you up and say that isn't what he/she prescribed?
Get a good lawyer, you'll have one heck of a good lawsuit there.
I understand you not being "sue happy", but just think, if you don't do this, then the same thing can happen to someone else and possibly with far worse repercussions than you suffered.

Yes I would. When I was a kid I had pink eye and my mother went to the pharmacy to fill a prescription for some kind of cream that I was supposed to smear right inside my eye. I was nervous about using it, so when she handed me the box and told me to put the stuff in my eye, I started stalling and reading the box instead and it said "DO NOT GET NEAR EYES". It turned out to be some kind of burn ointment or something. I could have been blinded by the stuff if I hadn't read the box first. I'm sure my family would have sued.

in my own opinion of coarse your physician had to have prescribed you the medication. After having to go to the pharmacy to pick it up im pretty sure it was the same medication your doctor prescribed you, or am I wrong? If the pharmacy happened to give you the wrong medication shouldnt you have known what type of medication was written out to you from the doctor.The best thing would probably be that you make a complaint to your physician

that's an absolute yes. mistakes happen but these people get paid not to make that kind of mistake. but the person two up from me is of course right too. if you have been taking the same medication for a while you should have realized that you are taking the wrong one. unless its something new you need to check the prescription because your doctor could be at fault as well.

what are you silly stupid or just simple minded damn right you should thats goes without saying instead of posting that stupid question you need to be on the phone calling a lawyer you dont have to be lawsuit crazy to sue someone exspecially when they almost killed you if you would have died do you think your family would be asking do i sue HELL NO next time you might not be so lucky and how many other people have they done too and got away with it SUE SUE SUE SUE SUE SUE SUE SUE SUE SUE

i cannot beleive you are asking the ppl this question, instead of a lawyer. what is wrong with you ?the pharmacy all most cost you your life and god know's how much damage it has done to your inside for year's to come. you do not have to be sue-happy but come on now! this gives anyone morer of a reason to sue he should have known better that why he got a dgree[i hope] i hope you will consult a lawyer you need one badly

Well, it may be a situation of life and death. If the wrong medication could have killed you then, maybe I would sue. Medication needs to be treated with extra care. Pharmacies need to take the initiative and be care full as possible.

I would sue for payment of hospital bills and maybe get a little for your new heart muscle problem but if your not sue happy don't put them in bankrupcy just to get a whole new wardrobe and new car. They definately deserve to be sued though and the person deserves to get fired or re-evaluated for his/her job.

I would do it but I would consult with a lawyer to see what my odd is first. The odd maybe different depends on the state. It will get expensive very quick too, unless you just want to go to small claim court.
