I said I would take the puppy back but would keep a hundred dollars for a security deposit. Well his check came back for NSF. Can I still take him to court for the deposit? I have to readvertise in the paper and feed this puppy till I sell it again.

Yes, you can sue for the $100 he agreed on paying you when you agreed on the return. Hopefully you have all that in writing?

Make a good faith attempt to get the funds yourself. Send him a letter (certified. returned reciept) to him politely explaining the check was returned and you'd like payment within a reasonable # days. You can't harass him about it... wait patiently for a reply. It could be an honest mistake.

Then if he still doesn't pay, fill in small claims for the $100 plus filing fees (probably about $40 in many areas).

Keep ALL your paperwork, notes, contacts, etc!

Send a letter to the check writer stating that check has been returned nsf,if payment is not recieved in ten days this will be forwarded to the magistrate for processing.The district justice will take it from there,the bad check is a crime and can be handled in about ten minutes with out a court hearing.

Not unless you had the agreement put in writing, signed by both parties, and notarized. A verbal agreement doesn't hold up in a court of law. Besides, you really can't sue someone for writing you a bad check, unfortunately. I think you're stuck with a puppy and out $100, but it's not so bad. Puppies are nice.

Yes, legally you are in the right but is it really worth it? Is it worth your time to spend a whole day in court for $100? I know it's about the pricipal but sometimes you should just let things go. Next time, be more selective about who you sell the puppy to.

you can take him to court for writting you a bad check. period don't even discuss him bringing the dog back.
