Why did't he get arrested? Just because he said it was a joke?

This guy went into a store, snatched a kid and then ran off. The police where called, but he man was not arrested, he said it was joke. The parents are suing...WTF? That is not funny or cool!

If there's no injury done to the kid, and if the kid was not brought to a location unknown to the mother and out of the mom's sight, then most probably no crime was committed.
