we have costody of our grandchild he is 3 he has been with us since birth his father in prison for the 3rd time felony charges mother [my daughter]knows he is better here for many personal reasons please help us and tell me where we need to go thank-you

For the adoption laws, go to this site: http://public.leginfo.state.ny.us/menugetf.cgi?COMMONQUERY=LAWS and click on "DOM Domestic Relations". Then scroll down to "Article 7 - ADOPTION" and click on that.

With consent of the parents it should be possible for you to adopt your grandchild, although whether that is necessary or wise is another matter; it may be sufficient to get an order of guardianship. Is there any reason to think that the father, in prison or not, is a danger to the child? Or that the mother will exercise parental rights capriciously?

There may be financial support for you as "foster parents" that would not be available to you as adoptive parents. There is no reason why you can't write your wills to put your estates in trust for the benefit of your grandchild, and you should make sure there is an independent executor-trustee (banks are expensive; perhaps you have a trusted relative).

There is much more that you need to know that I cannot explain here. Your public library should have good resources, as will the various child support agencies and charities.

You will have to get the written consents of both parents & file a petition for adoption with the Court. Some states have simplified consent procedures & waive the home study for grandparent adoptions. Hopefully, NY is one of them. You really need a lawyer to do this right & avoid problems.
