Good question. Hope you get some good answers and not just
yes or no. I think that some do like a Federal Job they not only do
an extensive background check but they also send you to the Police Station to ask if you have any Warrants. That to me was
worse than the piss test. The guy in front of me DID have an
open Warrant and two uniformed cops came out, put handcuffs
on him and took him away. NEXT!

like someone else said, some do, some don't. BUT unlike other answer on here, a background screening company or employer can ask whatever they want. Some states have rules about what a previous employer can say, but MANY states do not and employers can answer freely. A majority company will only give dates and title for fear of a lawsuit if they say anything else, but there are some, especially if it is document that will give information on things like attendance, violence, tardiness, and harassment issues. In fact, I know in Pennsylvania the Governor has shielded companies from lawsuits if they answer those questions honestly, as long has they have documentation and can show that it is factual.

By law they are not allowed to ask about your job employment, unless you are going to work for the government. They are only allowed to verify that you work at that job and the times you worked there. Now, if they don't ask about how good of a person you were and your old job offers without being asked, then they can find out about you.

Some do, some don't. Most employers will only verify start date, title and separation date. Some will state whether or not the applicant is eligible for rehire, but that's about it. There is too much chance for a lawsuit if you provide much more information than that.

Legally, they are only allowed to ask start and end date. They aren't to enquire why you were discharged, if you were, etc. If they do, and your ex-employer answers, they have violated your right to privacy.
