I tried to get a twin size mattress and box springs from a Rescue Mission in Galesburg, IL for a friend who has no bed and low income...long story...just came out of a divorce and starting over. The Rescue Mission said they sell them, even though they're donated...I said did u know that's against the law and he said, "Ok, well we need compensated for our gas for picking them up." !!!

I meant a "used" mattress...not new. Also, when I said I'm trying to help her, I meant by looking for a place that donates them cuz I dont have the money to buy one myself for her. I was told by the Salvation Army that the Mission gives them away. We figured we could spray it down good with lysol and put a cover over it if we got one.

Each state that has a law against selling used mattresses has its own regulatory commission.

The FTC's link is for deceptive practices. The company in that case misrepresented the mattresses as new, so that doesn't apply to your question.

If you suspect your new mattress is used, then you would contact the FTC and/or your state regulatory agency.

it would be extremely hard to enforce, but some states are doing that now with the bed bug problem going around. i wouldnt buy a used mattress for her if i were you.
When I was going through hard times just after a messy divorce and no money I bought an inflatable mattress for camping or whatever. I bought it at a discount store for like $15 and it is just as comfortable if not more comfortable than a regular mattress. I would completely recomend doing that.

It is against the law in Illinois to sell a used mattress. Public health issue but I don't think anyone enforces it.

Why would you be trying to get them in trouble for raising money for their charity and selling affordable bedding for poor people like your friend? You shouldn't be giving them a hard time. Would you prefer your friend sleeps on the floor?

Generally it's a Health Department regulation that prevents the resale of used bedding. In some states it may be legal if the bedding has been cleaned/disinfected.

I don't think there's any possible way that selling a mattress is against the law. What is your proof? Lots of secondhand shops sell mattresses, people sell mattresses...
