My daughter's dad has not contacted her in over a year, and since she was 3, (she's 10 now) he has only seen her about 4 times. No phone calls, no child support, nothing. The number I have for him doesn't work. How can I have his parental rights taken away? I can't contact him so I can't discuss it with him. What legal steps should I take to have his parental rights dissolved? My daughter wants nothing to do with him and wouldn't see him even if he did try. Please help.

DHR is involved, but he only works "under the table" jobs, so they can't find him and he can't be garnished. I have a large life insurance policy and if something happened to me he could come in and take my daughter just to get the money. He is unfit, a drug addict, and I wouldn't want her subjected to the life she would have if he was raising her. If he relinquishes his rights, it would put my mind and heart at ease.

You can hire a family law attorney to get his rights terminated. You don't have to talk to him about ****!
Get the legal papers in motion, if they can't locate him to serve him there are procedures in place the court takes to make the court decision legal and binding on all parties.

If you know his address, where he recieves his mail. You can hire an attorney, have them draw up a non payment of child support action and charge him with abandonment. Send it to him certified mail so he has to sign to get it, at the same time the same material will be sent to the county court house that will send him a summons to appear in court to face these charges, If he does not show up, then a warrent will be taken out for his arrest. They WILL find him and when they do they will hold him in jail until the total amount of child support is paid, OR he relinquishes his parental rights. That will take away the possibility of custody or rights to your money if something should happen to you. Good luck to you, and contact me via email if you need to talk further.

You situation sounds just like mine. My daughter is 12 her dad left when she was 3 and since then he has seen her 3 times and called her 1 time. He owes $37,000.00 in child support.
I went to a lawyer to get his rights terminated. There are pros and cons in this situation.
Pros- he has no rights to this child, she can be adopted by your current spouse-his family doesnt have a right to see her.
cons-if he wins a lottery or an inheritance you get nothing. his family can't see her.
If you go to a lawyer he will give you your options. You will have to go to court and if he doesnt agree to sign his own rights away then the judge will decide.

Contact an attorneys office and ask for advise. Do you really need parental rights taken away if the guy isn't around. Someday - way down the road perhaps they will be able to have a relationship of some sort.

Go to your local family services office. They will know the best person to contact about this. Most states now have an attorney who will do this for you even if you can't afford a lawyer. Good Luck.

I would have to agree with Quick -Sand's response.
Apply for food stamps, healthcare, etc...then the state will go after him for support. They will tell you to file in court for support and depending on where you live, you may be able to get a court appointed attorney, if you cannot afford one. The court will also tell him that he has to pay all of those years that he didn't pay.

If you go to the local D.A. of family court in your area and file charges. They can take it from there. If he is skipping from house to house and job to job, he can't be served. But as long as the charges are present, you will be in good shape.

think probably an attorney has to get involved, and why are you letting him get away with no child support.....file for food stamps, etc. the state will go after him, know his social security number?....nail him to a wall!!!
