is it court ordered? I don't know your laws . here the court gives custody to one parent, and in some states you can't move the child away from it's father. but if I was to make a better life for my child I would take the opportunity to do so. if it's just an agreement not in writing I would leave he has other kids.

partial custody in india if you are a american citizen then i would just take my son and leave because i would not stay in a country that i didnt feel comfortable once you are in the us he cant do nothing . but if he finds out some country believe the husband are father runs everything and the women really has no rights so you need to do it without him finding out just get on his good side and say you want to go visit some family and just never come back .but leave like you are going to come back like say can you check on my place while im gone for the weekend make him think you are coming back and you love india i will look at some laws and see email me

I don't live in India, or Canada. All I can say is get a lawyer about custody for your son, and see how you can find a way to live in Canada. A lawyer knows the law best, obviously.

Best of luck,

you are asking him to give up his son, and no father would do that. It's not about revenge. If the roles were reversed would u give up your son? If not, then don't accuse him of anything.
