because it can only do her any good these claims if she be able to prove it, which most often is impossible. Moreover, if a woman is abused multiple times, and fails to call the police, it is a form of giving consent to the abuser.

If you mention it, it becomes a big-deal issue that starts to overwhelm all others. If that is what you want to do, I suppose you should do it. It will complicate and cloud the issue if you have children, of course. I would talk to the lawyer about why his recommendation is not to mention it. There could be several reasons.

I would also agree that it has become so commonplace a complaint that judges tend to discount the significance. Frankly, if you did not have anything that could be called "abuse" in some modern definitions, you would probably not be getting a divorce. So mentioning it is hardly necessary, but would open you to counter-charges: she abused me, too; mentally rather than physically. Believe me, it happens, and you do not want to go that route.

Because assault is a criminal offence and the way to deal with that is through the Police. A divorce case is to end a marriage and decide on the disposition of assets, children etc. Once established that a marriage should end, 'blame' isn't at issue; how much of a git he was shouldn't affect any award.

If you are refering to the Paul Mc and Heather Mills case then they have said she shouldnt mention it as she wont recieve as much money now. Paul Mc would have paid her substantially more for a gagging clause and total privacy.

If youre not refering to that case I apologise...

Listen to your lawyer. Unfortunately too many people started claiming their spouse had abused them, and some Judges stopped listening. If you don't like your lawyer's advice, find another one. The lawyer is there to represent you, that is why you are paying them.
