The husband is screwed here. Any woman worth her salt should not go back to her parents after marriage - under any dire circumstances.
The only option is to wrangle in court and appeal forever. Hopefully the father-in-law passes away by the time the court comes to a ruling.

Who are you the wife or the husband? Both of u have been playing around with the institution of marriage .You guys really have lot of time to go to the court and fight out.If both of you are twice married and goin to courts again..there is some serious problem in u.Spare the child for gods sake.First u guys have to decide what you really wnat in ur relationship...ur foundation of relationship looks weak. How can ur FIL get in between u ?Take ur wife and run to a secluded place.Dont let any family members get in between u ,that requires ur parents also.Just three of u wambooz to some place....money anyway is not a problem for u guys. Then rediscover your relationship.Work on ur relationship as i think u guys must be over the hill by now with so many divorces.Just concentrate on your child and start fresh.Dont visit your country till the time you two are really bonded to each other. And stop the blame game on each other.I assure you the problems between you two will get solved. The more u run away from the problem got married to each other after facing so many failed marriages and u definetly must be wanting to save it any cost.Save the marriage for the childs sake.In india as per Hindu marriage act child after 7 yrs can decide with whom he wants to stay.Any way i would not suggest that u get the child to the court.Get to meet ur wife and talk to her and just go somewhere where nobody gets in between u.

If he or you have been married 2 or 3 times, then maybe you or he need to look at themselves as to why the wives agree to leave. If a wife is happy she will not leave her husband. I hope all works out.

The situation is complex and messy. I would not get involved. They've got $'s, so they can get any kind of help they want. There is no winner here. It is very sad for the child.

Certainly your life is in mesh. I don't believe in divorce, but i too have to think twice.
If possible, take her to psychologist to maintain your life peacefully.
