A law suit is quite possible in both Canada and the U.S.A., as calling a person or referring to them as a gringo, is in all fairness "Racial Slur" which is illegal. We used to refer to negroes by another name, didn't we? Well if you cal or refer to a coloured person by this other insulting name, then it is a racial slur and is a punishable offense by law! By the same pretext, calling or referring to another person as a "gringo" is a "racial slur" and yes you could very well be facing legal actions with detrimental consequences!Would you appreciate it, if you were called a racial name, I doubt you would be willing to accept such an insult towards yourself or your family ! It's time to grow up and start showing respect to other people even if they fail to show you respect !

Company could be sued if they didn't follow their policy on verbal harassment and going through with the rules and guidelines in regards to the process of reprimanding the employee. To anyone who thinks it's okay to call people names at a work place. The point is is that it's at a work place. There is a different set of rules the company and it's employees must follow to ensure a reasonable work environment.

Yes a law suit can legally be filed. The company does need to enforce it's harassment policy, however sometimes you just need to overlook some things. Being called names, although sometimes irritating, is not as serious as physical abuse or sexual harassment. Sometimes all it takes to get stuff like that to stop is to refuse to let the other person's comments bother you. Often times when they realize it won't make you angry they'll stop. The only reason they keep doing it is because it gets to you. Don't give anyone that kind of power.

It seems to me the suit should be against the person making the slurs not the company. But you could try a lawsuit, it might encourage the company to fire the person who is going to cost them money.
