In part the answer may depend on "how public" the acts are. And can there be a "religious defense" for semi-public lewdness in a religious setting (thinking of the Rev. David Berg and his Children of God)? Or a "privacy defense" (under Lawrence v. Texas http://supreme.justia.com/us/539/558/case.html ) for "party sex"?

Hi there,
As mentioned by some of the people here, sex in public place is an offence. Why don't people get caught?
I guess the police have more urgent incidents to attend to rather than catching people having sex in parks. Thats why they aren't stepping up patrols in such areas. Moreover, as long as the female counterpart is not accusing the male of rape, i think its not really an issue as both parties are kinda enjoying. However, be sure to get visits from your neigbourhood police officer while having sex in a park if some concerned auntie lodge a complaint.
Indecent exposure is an offence however, it depends on the scenario. If a pyschotic male start showing the world his manhood, i'm sure the police will treat that as a case of interest but if its a couple just making love, i think the police will not bother them unless someone lodge a complaint.

You'd be surprised at how many things are illegal and on the books. You have laws at every level of govt. from the fed to little tiny city governments. But, many of these laws are not enforced, they are usually ignored until the problem becomes bad enough to enforce again.
For example public sex, nudity, lewd conduct and so on are illegal almost everywhere. However, if the displays are not overt, no one is harmed and nobody presses the issue (press charges) then they'll let it go. However, this is a kind of thing that would depend on the mood predisposition of the officer who catches the offender, the location, time, etc.
If you're going to do it don't do it where there are children, because if you ever end up in court it will look pretty bad.

Yes ! is an offence to have sex in public places. There is 2 reasons why couples are not caught because they don't do it openly and they are broke, cannot afford to check into a budget hotel, so how to fine them ?

Yes. Committing lewd and indecent acts in public and indecent exposure are just a couple of the things you could be charged with. I don't know of the island you mention but if people are doing it and not getting caught, I would say they are extremely lucky. It's only a matter of time...

Politely, I would like to address this as an issue, in morality....
First, sex in public is called " indecent exposure" and is a crime.
Second, sex should be revered as a bonding between a man and a woman; held sacred and personal.
I know that in these so called (modern times) my view tends to be out- of -date....
However, if intimacy is so mechanically disregarded, then the relationship is exploitative and fetish, at best....
A King should never exploit his Queen like a cheap prostitute and a Queen should never portray her king as a desperate Trick.
Will you still respect me in the morning?

yea,but there are ways to not have indecent exposure,and actually do it in public,but the various states of being visable leaves it to whom ever is effected the sight of it no matter what is exposed or not exposed, the person is effected one way or the other leaves it the how it has effectred them.
so if you get caught by a monk sworn the celibacy he may be effected in a way that is has shocked hom so bad it comes doen the lewd and vacicous behavior.
or be seen by a porn star and they want to know how it works,and actually comments on your tact.
or you get horny in a bar with your boyfriend and the bouncer tries to bribe you both by saying either you allow him to have sex with both of you or he is calling the cops.

Sex in a public place is Scandal as a crime defined in the Penal Law. Thus, persons engaging in sex publicly can be prosecuted for a crime.
