Our divorce is almost final. We where together for seven years, and seperated for almost three.(not legally seperated) She may possibly be pregnant from the guy she left me for.

What a friend of a friend told me this evening is that I could have to pay her child support for this baby, even though it is not mine.

My question is, can this be true?

It would be Colorado state law's that I would be governed by.

Only the "Father" of the child has to pay child support. When she gives birth ask for a paternity test. There is NO way that you'd have to pay if it's not yours.

Once the infant is born, out of the right thing to do is pay child support. Have it documented, reciept and all with both signatures on it. Documented once DNA test will be done and this baby is not yours, she will have to re-pay you back on what you paid.

You also can make it where you have DNA done first, then do back payment on child support where you don't have to deal with the whole "I won't pay you back" routin.

To my understanding, you do not pay for a child that is not yours. That would be a huge heated debate if that was true, as I never heard a guy who had to pay for a child unwillingly that wasn't his.

You do not have to pay child support unless your name is put on the birth certificate. If that happens, yes, you will have to pay. Then you must get a genetic test to see if you really are the father, and if your not, you then change the birth certificate and no longer pay. The genetic test CAN be done before the baby is born, it is best to do it as soon as possible in these situations.

no state can charge a person with support of a child that isn't theirs except if if you went into a marriage with one existing and took the child as your own, you can be made to support. even though your seperated, the guy she was with is legally responsible for the child support.

No you can not be held accountable. If she goes after you for childsupport, the support order comes with a 30 day contesting form and a form to fill out to request a paternity test. I would take the test. And not to mention if she lists him as the father then no mater what they will go after him.

if you are quite sure the child is not yours, request a dna test, and unless the dna tests say that you are the father, the only way you would have to pay support is if you adopt the baby as your own which from the sounds of it, that is not likely. good luck.

If you get a paternity test proving it ain't yours, you should be free from child support, but she's still going to be able to get you for alimony, and the courts will take into consideration she's about to birth another child, so either way she's going to get to take a big sloppy bite out of you.

I have never heard of that before. If that is the law then something is wrong with our country. She was unfaithful and she had sex with another man who might be the father. He should be the one who is responsible for that baby not you.

Your friends friend is blowing you, if you are not the father you have no legal responsibility for the child, in any state.

yes you pay because you have been married to her for a year
get a DNA test asap and put in to writing that if child is not yours you will not pay get a lawyer also to make it legal
