Technically it is but since u are already going thru a divorce, why does it matter?

JAG is not going to help because it's a civilian matter for the family courts, not a military matter. Since he is still married to her, she is a dependent. And since she had a child while they are married, he is assumed to be the father of the child. He needs to consult a lawyer and get the divorce finalized, even if she refuses to sign the papers. Then, see if he can prove paternity and have the child dropped as a dependent.

You are automatically assumed to be the father if she has a child within a certain period of time after the divorce in some states, get an attorney and good luck.

I don't know where you're from, but, on my end of the globe ... if your wife got pregnant before your divorce is finalized ... that child is considered to be yours. To avoid paying paternity on a child that you didn't father, one would have to request a paternity test ... to prove otherwise. Good luck ... hope everything works out alright for you.

BTW: Yes, it would be considered adultery.

What difference does it make if you were all ready going through a divorce so what if she got pregnant she is not trying to blame it on you so why care.

If she got pregnant after you were already separated, the court wouldn't rule it as adultery. You should just get your divorce and stop trying to dig up dirt on your soon to be ex. Get on with your life and be glad that you got rid of her when you did.

Yes! In Texas if she is pregnant you can not get divorced until she has the child. I would assume it is the same in all states to protect the child!!

That's really too bad, and I am sure you are going through a very difficult time. Not sure that it matters what you label her behavior, though: it's her behavior and it's her consequence. Looks like she's moved on. All the best to you in moving on in a positive direction in your life.
