I recently left my job and i gave them a week notice. Now they do not want to pay me for my vacation time that I have accrued. A co-worker did the same thing and they paid him for his vacation time.

Depends on the company you work for and the state you live in. Some companies only pay you 50% of unused vacation time. Others don't call it "vacation" so that they don't have to pay you for it. Some call it "personal" time others call it "Accrued sick time" Some employers require you to give a full two week notice in order to be paid for unused PTO. Just learn from this experience that it is ALWAYS smarter to take vacation first and then while you are out give your notice. Once vacation time has been approved they won't take it back and then you don't have to lose any portion of it.

You are entitled to the vacation pay and they should pay you. If I am not wrong, it is 4% but to ensure, please check out the percentage with the local employment standard branch or their website as I don't know what city you're living. If the employer does not want to pay, you can file a claim through the labor law and send them a copy of the claim. Many employers usually pay off the vacation when they receive the notive.

You most certainly are!If your previous employer will not pay you, since you did accrue it,you can file a labor complaint, and they are responsible for interest accrued on it since it is considered a source of income.

I'm not sure what the law says but I do know that they need to treat employees equally. You weren't a contractor when compared to the co-worker as an employee?
