My car is in the shop and all that needed to be done was going to be 9.5 hrs worth of labor, the dealer quoted the same, now they want to be paid for 3 more hrs worth of labor can they do this?

Yes, but only with a verbal authorization from the customer.. If you have a problem with this go right to the service mgr. If no satisafaction, ask for the dealer principal.

An Estimate is just that... an idea on how long something should take and the cost. But sometimes stuff comes up that needs to be taken care of that would not be found without taking it apart.

But usually good business practice is to call the customer to let them know how much and why the cost of repair is going up

They sure can. If they did something other than what you told them to do I would picth a fit. Now if it takes 3 hrs longer to do the work you signed for then that's the way that is. I have helped work on cars & sometimes it just takes longer than what it should. The list of reasons why is endless.
Laws are not the same for all states so check out what your state laws are.

You don't mention your state so know one can answer the question for sure! In NYS we have a registration number for every repair shop doing business in the state. If they pull that stunt you report them and the state goes after them including closing their doors. They are allowed to charge 10% in excess of any written estimate and must return parts to the owner if requested! As you know the later is nonsense but the first is pretty much enforced here! I suggest you call your state attorney general for information regarding your states requirements!

They are businesses and definitely will try to gain higher incomes. Had a friend who wrecked her car and they gave a cheap estimate. After the insurance got done with their estimate, they moved up the costs by 30% because they know its a big company paying this bill.

I'm sure somewhere on the estimate that it says "estimate" which means it is an estimate.
