After a final decsion in the trial court the party that losses files a Notice of Appeal. Documents will be shipped to the higher court along with notice that the party which appealed has to file certain things (such as a brief) within a certain period of time. The other party responds. There is usually a hearing at some point before the other court where they argue their cases. What appeals courts normally do is not decide whether the lower court made an incorrect decsions on the facts--but whether a mistake on the law was made.

With each type of court there are some variations and complexities involved. First year law students take a year long course that is largely devoted to this. But that is the basics

By the way someone said you can not appeal just because you want to. That is wrong. The appeals court decides after the appeal is filed and argued whether there is any merit to the appeal.

you cannot appeal just because you want to there has to be a reason why you are appealing. you have to have a legal base for your appeal..because you loose is not a reason..unless it is a death penalty case, then there are manditory appeals, even if the murder was on a video tape infront of a bunch of cops

You go to a higher court and have your lawyer appeal it.
