With respect to justiciable questions, that is, questions that are amenable to judicial resolution, the United States Supreme Court has the final word. However, with respect to political questions or questions that may be settled by legislation, Congress may have the last word by the enactment of a Federal law that is within its power to enact (and these days that's just about anything), and that law will trump any contrary or inconsistent state law by virtue of the Supremacy Clause of the United States Constitution. The Supremacy Clause is contained in Article VI of the Constitution, which provides, in part, that:

"This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, SHALL BE THE SUPREME LAW OF THE LAND; AND THE JUDGES IN EVERY STATE SHALL BE BOUND THEREBY, ANY THING IN THE CONSTITUTION OR LAWS OF ANY STATE TO THE CONTRARY NOTWITHSTANDING." [emphasis added]

The U.S. Supreme Court actually would weld this authority - but it is the Supremacy Clause in the US Constitution that states that Federal Law is always superior to State Law except in those areas that there is no guiding Federal Law.

probably the supreme court, handpicked by the president, so they arent very impartial. Federal laws trump state laws unless the state laws are stricter. It also all boils down to money, if the feds want the state to do something, they dangle that money as carrot or stick.
