My husband pick up the kids for his normal summer visit in July, and they never came home. He enrolled them in school in another county and was allowed to disenroll them from my school w/out my permission. After trying to figure out the legalities I just went and picked them up from their afterschool program. I'm going to file an "Intrerferance with Custody Order" tomorrow, but I wanted my children with me today. I have their birth certificates, court papers, and ss cards to start the enrollment process, but according to GA state law only the person that enrolls them can disenroll them from the school he placed them in. I need your help. I've contacted our backlogged Legal Aid Department and was advised that based on my documentation I was well within my rioghts to take the kids. What should I do know? He;s threatened to take them. Can he do that?

What he is doing is basically called parental kidnapping and you can be arrested for it. If he takes the kids without you knowing it and youre the primary resident custodian parent assigned by a judge then he can go to jail for it. You are responsible for those kids and have legal documentation to back it up, then you can take those kids back and can get police helpto do so if needed. He can threaten all he wants to which is illegal but will still have to take you back to court with hard concrete evidence proving you as an unfit mother and not hearsay. The judge will be especially interested in his threats to you so document any and all contact with him. The next time he takes the kids without your permission, notify the police immediately. As for the school, since he doesnt have legalcustody of them he cant enroll them anywhere without your written permission so just remind theschool of such and can get into legal trouble themselves so you have nothing to woorry about here. No but it going to be a very disturbing process for your childen as they also love their father.Keep in contatc with you legal department as they will be the ones who will be helping you in the courts when it all comes to the crunch.Keep the court papers close to you at all times as you dont need to pput up for any charges like kidnapping when you go to get them,as if you get pulled over their will probably be allot of questions, and they may take your children in to government hands untill it is all sorted out, which causes greaf for your children and that dont need that.
