We became 3 mos past due in our HOA dues. (it has gone up 4 times in 2 yrs!) I explained that we had both lost our jobs in 1 month, along w/health insurance, and have a new baby & 8 yr. When my husband got a new job, I tried to make payment arrangements, but the attorney refused my offer and won't return my calls. They have filed a lien and say they can force me to sell my condo. I am disputing the balance they say I owe ($2500.00) I think it should be more like $1500. This has gone on for the last 3 months. I have paid (on time) and each month they return my check to me and then charge me a late fees!. The attorney says they can legally not accept my payments. My balance just keeps getting higher and higher and the attorney won't return my emails or calls. He is threatening to force a "lien sale"?? Is this legal? I want to pay off what I rightfully owe, but they won't even discuss the errors or legal fees they have added. Can I lose my condo over what started out as 3 months HOA dues?

Payments must be received if given in good faith for past dues. If the creditor do not want to receive the payment, the debtor can deposit it in court and file a case against the creditor. The receipt of the court of the amount will stop any interests that can be claimed by the other party.
