My boyfriend got married in Kentucky right out of High School. I'm not sure how old his wife was at the time of marriage but we just found out his name is spelled differently on his birth certificate than it was on the marriage certificate or any other document. Does this still make the marriage legal and binding? He would have signed all the documents with a name that didn't match. Does anyone have any good ideas about this?

His name is Michael, it is spelled on his birth certificate as Micheal. He is planning on getting a divorce but I was just wondering if this would keep him from having to do so. He has also been seperated from her for almost 3 years.

If any of the documents are actually signed by him using a different name than his legal name, usually birth name unless legally changed, constitutes fraud or the intent to defraud. So first you would have to make sure he didnt legally change his name without your knowing it or you could end up in more legal trouble than him. If he cant spell and signed without the intent to willingly and knowing commit fraud for whatever purpose, then you have nothing

I believe that it is still legal becuz he is the one that signed the documents.. Your best bet would be to call a lawyer and just ask questions.. But for the most part he is going to need to file for a divorce

so ur dating a married guy? classic..good job! anybody who got married in kentucky probably married their sister or cousin anyways so u can just strike the marriage invalid....he shud know how to spell his last name so if he signed documents with the wrong signature maybe its time u moved on.....

if he is trying to get himself out of the marriage
and you my dear are looking for a way to help
put yourself in the wife place as well as the children if their is any
and for him to found out go see a lawyer
by the way remeber that he feel income tax with that wife
he might just own that IRS money

It is still legal. He'll have to have it annulled or get a divorce or disillusion to get married to anybody else, or he's committing a crime.

he's your boyfriend...and he's VERY MARRIED...!!! what is the matter with you? This dumb butt crack needs to get a divorce..and you shouldn't be seeing him or having a relationship with this dude until he does....His marriage is legal and binding until he is divorced!!!

i know in ny it does not matter it still would be binding so i'm guessing it still would have to be dissolved by a judge
