and suddenly a security gaurd stops you, tells you to follow him, so you do.... he takes u upstairs to a room with a tv and shows you footage of your friend stealing... asks you for his name and if you know him, not wanting to 'snitch', you say no... he warns you but you still say no... remember now, u did nothing and were walking out alone and nothing on you... can you get arrested and left in county jail for 5 days???? is this legal?

Nope.

Not only that, if you refuse to go with the security gaurd, and he aprehends you anyway and won't let you leave, that's felony kidnapping.

Tell the rent-a-cop to get lost or call the police. And don't forget to tell the real cops that the rent-a-cop grabbed your privates too.

If you are scene with the person stealing, that's classified as an accomplice act. But, in your situation, I would simply tell the security guard to go and confront your friend. Explain, in a none-defensive manner, that you have done nothing wrong and had no idea your friend was going to steal in the store. As long as you're not being disrespectful to authority, they have no reason to arrest you.

Nope. What were you charged with? They should have approached your friend. However, it is actually very difficult to get people for shoplifting. Otherwise, they would not have harassed you.

You don't have to tell some security guard a damn thing. However, you do have to cooperate with the police. Did the police question you and did you lie then?

No, it's unlawful. But according to a bill Bush signed today, it now makes no difference who is detained, for how long and where. If you get put in jail, sue the hell out of this store.

no, u can't get arrested unless the case is referred to the REAL cops, and they press charges (like withholding information). But, it should be more likely that the guard question and detain ur friend vs. asking u all those types of questions.

The guard is only doing the job. Its what they are hired to do. What the referal to jail is: accesory to a theft and withholding imformation. As to if this person is a friend ? I hope not.
