No, it's because they didn't cooperate. I don't think the cooperation is right or wrong, it's just that each case is different. Cooperating and giving information doesn't mean they will live either. They may be killed regardless. Giving the information and being allowed to walk away could leave a lifetime of remorse.

Personal values and beliefs are probably what would be the answer. Dying for believing in them are probably far more important to the tortured than the torturer and that would squelch the mistake of being suspicious.

People are not normally tortured or killed by the authorities or military personnel unless they have done something to deserve such treatment, such as commit acts of terrorism.

If they die during torture, it could be argued that this is the risk they take when they hook up with other terrorists and begin doing crimes against everybody.

No. Haven't you ever seen the movies where someone is gonna get their face blown off if they don't tell someone where the "goods" are?
But the protagonist doesn't KNOW where the goods are. But the antagonist doesn't believe them. And, because the protagonist can't come up with the goods he gets his face shot off.
Sheesh, watch an old western or something.

that's like asking "If a girl wears a mini skirt, is it her fault for getting raped?"
I think the answer is no.
Pretty sure both the torture and the rape shouldn't be taking place no matter what.
