husband left me and kids 12 years ago with my best friend but came back after 6 weeks can i still name her in the divorce 12 years later ?

beleive me there is nothing worse than a woman scorned and just wanted to make her squirm for the torment i have been through.

Darling, you can do what ever you want. It is your divorce and you are rightfully upset about everything that has happened. Let it out. Whether it was 12 days or 12 years get it out. It won't help your settlement case at all, but it will make you feel better and that is what is important right now. You feeling better!

If nothing else it will just put an essential blot on his character.

Actually, no. That has been too long ago and since you accepted him back for that many more years shows you had forgiven him. There must be other reasons if you are now divorcing him. A little insight, try to keep it as clean as possible for the kids's sake. Try "irreconcilable differences". It's all inclusive and non-specific. Make sure you have a good lawyer that specializes in divorce.

Why do you want to divorce now? It can't have taken almost 12 years to decide whether his affair has broken your relationship.

I'd speak to your husband and tell him you want to divorce under the justification of irreconcilable differences. If he refuses, then say that you'll justify it under the affair from 12 years ago. Say that you forgave him then, but have been told of more recent acts of infidelity.

He'll be happy with the irreconcilable differences because an affair looks worse for him.

Honey the divorce and name slinging is 12 years too late. Once a cheater always a cheater. I bet at the time you thought you won the golden prize when he chose you over her, huh? You've always been the loser here.
Forget the 12 year old affair and name your issues today.

name her as what? Did YOU TaKe him back after he ran off with your best friend? are you suprised your getting a divorce now? if he cheated 12 years ago what's the point of naming her now you forgave him right/??? confused a little by your question.

Unfortunately in the UK, no. For you to divorce him on the grounds of adultery you have to file within 6 months of discovering it otherwise you are deemed to have given your consent.

I feel most sorry for your kids if they had to live with you 2 and all that baggage and animosity for 12 years.

I bet in another dozen years you will be sooooo suprized when their relationships break down.

Kids learn what they live. Please let them live with a bigger person than they are living with now.

i don't see why not. if 'she' is the reason behind the divorce, then you can't refer her as 'she' in court. But I'm curious as to why you waited so long (12 yrs) to divorce your hubby after what he did to you. I sure wish you luck.

No. If you've slept with your spouse after knowing he slept with someone else, the court considers that forgiveness. You can't cite that incident again. You'll need a newer act of adultery.
