I have a mobile phone with Orange that i upgraded on the 21st september 2006. The phone has been diagnosed as faulty by Orange and a replacement offered. However, they have offered me a reconditioned replacement instead of a brand new one. i know that within 28 days i get a brand new replacement if its faulty but does that 28 days start from the day i upgraded (21st September making it the 29th day today) or does it start from the day which i received the phone? (the 25th - making it the 24th day today). All the shaven monkeys at Orange can say is (and i quote) "nowt i can do"

Assuming you live in the UK.

This comes under the Sale of Goods Act 1979 (As amended) s. 14 (2B) You are entitled to a replacement or your money back, forget the dates they have given you.

If they persist with this reaction, don't argue with them just go to the Office of Fair Trading, they will do it for you.

either way shouldn matter. the law states that if any product goes faulty within the first 6 months, the responsibility lies with the retailer. the 28 day limit for mobiles is illegal. tell them you intend to report under section 14 of the sale of goods act, 1979

It should say in the terms and conditions that they can either replace or repair it, and sometimes says something about receiving a reconditioned unit. I think they're within their rights, so long as it works.

Go into the orange shop, in every mobile phone shop there is a troll working there! Be ridiculously flirty with her and you'll soon get a brand new, and better, phone!

I'd say it was from the date you received the phone. I assume they'll have a copy of the date you received it? Get on the phone to a manager and tell them you'll be taking legal action.!

It should be from the day you recieved the phone... after all, how could you tell it was faulty before you actually get your hands on it??

Suggest you get in touch with your Local Trading Standards office they will advise you correctly. Or try looking at www.click2complain there's a place for telecommunications questions and answers.
